Qualified Electronic Archiving : The End of Paper

Until now, the probative value of an archived digital document depended on disparate national laws. eIDAS 2 establishes the Qualified Electronic Archiving service.

  • The Major Legal Asset : Article 45j of the regulation stipulates that data preserved via a qualified archiving service enjoys a presumption of integrity and origin for the entire preservation period. In the event of litigation, the burden of proof lies with the opposing party (reversal of the burden of proof).  

  • The Economic Opportunity : For companies (banking, insurance, industry, HR, etc.), this means the ability to digitize the most critical workflows (contracts, payslips, invoices, industrial blueprints) without legal risk, drastically reducing paper management costs and accelerating audit processes.  

The NIS 2 Directive : Governance through Accountability

The NIS 2 directive expands cybersecurity obligations to over 10,000 entities in France (SMEs, mid-caps, local authorities).

  • Executive Liability : Compliance is no longer delegated solely to the IT department. Executives are now criminally and financially liable for cyber risk management.  

  • Link with eIDAS : The use of qualified trust services (signatures, seals, archiving) is becoming a technical benchmark to prove compliance with NIS 2 security requirements (data integrity, strong authentication).  

The European Digital Identity Wallet (EUDI Wallet)

By 2026, every Member State must provide an EUDI Wallet. For companies, this is not just a citizen app; it is an instant KYC (Know Your Customer) tool.

  • Business Use Cases : Companies will be able to verify a client's identity, age, or professional certifications in seconds with absolute legal certainty, thereby reducing document fraud and customer onboarding costs.   

AI Act and Data Act: Transparency and Sharing

  • AI Act : This imposes CE marking for high-risk AI systems. EuropaNum will assist companies in navigating the complex technical documentation required.

  • Data Act : ​ This mandates manufacturers of connected devices to share data with users. It presents an opportunity for French maintenance and third-party service companies to break manufacturer monopolies.
